vgraffiti Terms of Service

These Terms of Service govern use of vgraffiti, including the mobile app, website, admin website, maps, AR views, pins, badges, scavenger hunts, sponsorship tools, leaderboards, SMS features, and related services.

Acceptance

You may not use vgraffiti unless you accept these Terms of Service and the Privacy Policy. The app and website may require you to check acceptance boxes before access is enabled. We may store the accepted version, timestamp, account ID, and acceptance source.

If you do not agree, do not use vgraffiti.

Real-World Safety

vgraffiti is a real-world location app. Pins, hunts, maps, AR indicators, badges, sponsor placements, directions, distance estimates, and other content may encourage movement in physical spaces. You are solely responsible for your safety, surroundings, conduct, decisions, and compliance with laws.

Do not use vgraffiti while driving, biking, operating equipment, crossing streets, walking near traffic, entering unfamiliar areas without awareness, or doing anything that requires your full attention. Stop using the app whenever conditions are unsafe.

You must watch where you are going, obey traffic laws, use sidewalks and crosswalks, avoid hazards, respect weather and daylight conditions, and follow instructions from property owners, law enforcement, event staff, schools, parks, public officials, and posted signs.

No Trespassing or Unsafe Access

Do not trespass, enter private property without permission, enter restricted areas, cross barriers, climb structures, enter construction zones, approach dangerous animals, interfere with traffic, block entrances, disturb businesses or residents, damage property, or ignore any sign or instruction.

Digital pins, AR markers, maps, hunt names, sponsor placements, badges, and prize descriptions do not mean a location is public, lawful, open, safe, accessible, supervised, or appropriate for every user.

If a pin or hunt appears unsafe, unlawful, inaccessible, or inappropriate, do not approach it. Leave the area and report the issue to vgraffiti or the hunt organizer.

Not a Navigation or Safety Service

vgraffiti is not a navigation service, emergency service, security service, rescue service, child supervision service, transportation service, or public safety service.

Maps, AR displays, distances, pin locations, hunt routes, local hunt lists, business information, sponsor information, and app notifications may be inaccurate, delayed, unavailable, incomplete, or wrong. You must make your own real-world decisions.

Never rely on vgraffiti to avoid danger, locate safe routes, determine legal access, contact emergency services, supervise minors, or confirm that a place is safe.

Accounts and Roles

You are responsible for your account activity and for keeping your login information secure. Account roles may include participant, creator, junior admin, full admin, sponsor, and owner. Role access can change at any time.

Pins, Badges, Hunts, and Leaderboards

Users may create or view pins with text, business names, locations, photos, videos, links, or sponsor details. Administrators and organizers may create scavenger hunts by naming a hunt, setting pin claim distance, selecting or placing pins, describing prizes, setting start/end timing, and allowing users to join.

vgraffiti may remove, hide, expire, correct, or refuse pins, badges, hunts, leaderboards, sponsor placements, or prize listings to address errors, abuse, safety issues, legal concerns, duplicate records, fraud, or app integrity.

Organizer, Admin, and Sponsor Responsibilities

If you create or manage a pin, hunt, event, sponsor placement, prize, or leaderboard, you are responsible for choosing lawful and reasonably safe locations, obtaining permission where needed, confirming public access, setting fair rules, supervising participants when appropriate, and updating or removing unsafe content.

Sponsors are responsible for accurate sponsor information, lawful offers, and honoring any advertised terms. Sponsorship does not mean vgraffiti endorses a sponsor, location, product, or service.

Minors

Minors may use vgraffiti only with permission and supervision from a parent or legal guardian. Parents and guardians are responsible for a minor's use, movement, safety, account activity, purchases, and participation in hunts or events.

Prizes and Promotions

Some hunts may mention prizes. Unless vgraffiti states otherwise in writing, prizes are provided by the hunt creator, event organizer, or sponsoring business, not guaranteed by vgraffiti.

User Content

You are responsible for content you create or upload, including pin text, business names, photos, videos, links, sponsor details, hunt information, prize descriptions, and profile content. You may not post illegal, unsafe, misleading, infringing, harassing, or privacy-invasive content.

SMS Terms

If you opt in to SMS messages, vgraffiti may send account, verification, service, support, safety, badge, hunt, and app activity messages to the mobile number you provide. Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help. Consent to SMS is not required as a condition of purchase or app use.

Mobile numbers and SMS opt-in consent are not sold, rented, or shared with third parties or affiliates for marketing or promotional purposes.

Assumption of Risk

To the fullest extent permitted by law, you knowingly and voluntarily assume all risks associated with using vgraffiti, including risks related to walking, travel, public spaces, private property, traffic, weather, terrain, stairs, falls, animals, people, crime, property damage, personal injury, illness, disability, or death.

Disclaimers

vgraffiti is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, safety, and reliability.

Limitation of Liability

To the fullest extent permitted by law, vgraffiti and its owners, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for lost profits, lost data, property damage, personal injury, illness, disability, death, or other losses arising from or related to vgraffiti, user content, third-party locations, hunts, prizes, maps, AR features, sponsor placements, service interruptions, or unsafe use.

Nothing in these terms limits liability that cannot legally be limited, including liability for gross negligence, willful misconduct, or other non-waivable rights where applicable.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless vgraffiti and its owners, officers, employees, contractors, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your use of vgraffiti, your content, your pins or hunts, your sponsor placements, your prizes, your violation of these terms, your violation of law, your unsafe conduct, or your violation of another person's rights.

Changes

We may update these Terms of Service as vgraffiti changes. We may require you to accept updated terms before continuing to use the app or website.
